These Terms of Service ("Terms") govern your relationship with SCB - Samoa Commercial Bank and the use of our banking services and digital platforms.
1. Definitions and Interpretation
In these Terms, unless the context otherwise requires:
- "Bank" means SCB - Samoa Commercial Bank, a financial institution licensed and regulated under Samoan banking law.
- "Customer" or "You" means any individual or entity that maintains an account or uses services provided by the Bank.
- "Account" means any deposit account, credit account, or other banking facility maintained with the Bank.
- "Services" means all banking products, services, and digital platforms provided by the Bank.
- "Digital Platform" means the Bank's website, mobile applications, and online banking systems.
- "Transaction" means any banking operation including but not limited to deposits, withdrawals, transfers, and payments.
2. Acceptance and Agreement
By opening an account or using any of our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and all applicable laws and regulations. Your continued use of our services constitutes ongoing acceptance of these Terms.
These Terms form a legally binding contract between you and SCB - Samoa Commercial Bank. If you do not agree to these Terms, you must not use our services and should close any accounts you may have with us.
3. Account Opening and Eligibility
3.1 Eligibility Requirements
To open an account with SCB - Samoa Commercial Bank, you must:
- Be at least 18 years of age or the legal age of majority in your jurisdiction
- Provide valid identification documents as required by law
- Meet our customer due diligence requirements
- Not be subject to any legal restrictions that would prevent account opening
- Comply with all applicable anti-money laundering and counter-terrorism financing regulations
3.2 Account Opening Process
Account opening is subject to our approval and completion of all required documentation. We reserve the right to decline any application without providing reasons. All information provided must be accurate, complete, and current.
4. Use of Services and Accounts
4.1 Authorized Use
You may only use your account and our services for lawful purposes. You are responsible for all transactions conducted through your account, whether authorized by you or not, unless we determine that unauthorized access occurred due to our negligence.
4.2 Security and Access
You must maintain the confidentiality of your account credentials, including passwords, PINs, and security codes. You must immediately notify us of any suspected unauthorized access or security breach. We may suspend or terminate access if we suspect unauthorized use.
5. Fees and Charges
You agree to pay all fees and charges associated with your account and services as outlined in our current fee schedule. Fees may be debited from your account without prior notice. We reserve the right to modify fees with appropriate notice as required by law.
Interest rates, where applicable, are variable and may change at our discretion in accordance with market conditions and regulatory requirements.
6. Transactions and Instructions
6.1 Processing of Instructions
We will process your instructions in accordance with our standard procedures and cut-off times. Instructions received after cut-off times may be processed on the next business day.
6.2 Transaction Limits
We may impose daily, weekly, or monthly limits on transactions for security and regulatory compliance. These limits may be adjusted based on account history and risk assessment.
7. Prohibited Activities
You may not use our services for:
- Any illegal activities or transactions prohibited by law
- Money laundering or terrorist financing activities
- Transactions involving sanctioned countries, entities, or individuals
- Activities that could damage our reputation or violate our risk policies
- Unauthorized access to other customers' accounts or information
- Any activity that could interfere with the proper functioning of our systems
8. Account Closure and Termination
8.1 Voluntary Closure
You may close your account at any time by providing written notice and settling all outstanding obligations. Account closure procedures may take up to 30 business days to complete.
8.2 Involuntary Termination
We may close your account immediately without prior notice if:
- You breach these Terms or any applicable law
- Your account shows suspicious or fraudulent activity
- Required by law or regulatory authorities
- You fail to maintain minimum balance requirements
- You provide false or misleading information
9. Intellectual Property Rights
All content, trademarks, service marks, logos, and intellectual property on our digital platforms are owned by or licensed to SCB - Samoa Commercial Bank. You may not reproduce, distribute, modify, or create derivative works from our intellectual property without express written permission.
10. Data Protection and Privacy
We collect, process, and protect your personal data in accordance with our Privacy Policy and applicable data protection laws. By using our services, you consent to such data processing as outlined in our Privacy Policy.
11. Limitation of Liability
To the maximum extent permitted by law, SCB - Samoa Commercial Bank shall not be liable for:
- Indirect, consequential, or punitive damages
- Loss of profits, business opportunities, or goodwill
- Damages resulting from system downtime or technical failures beyond our control
- Actions taken in good faith compliance with legal or regulatory requirements
- Third-party actions or omissions
Our total liability for any claim shall not exceed the amount of direct damages actually incurred, up to a maximum of €10,000.
12. Indemnification
You agree to indemnify and hold harmless SCB - Samoa Commercial Bank, its directors, officers, employees, and agents from any claims, losses, damages, or expenses arising from your use of our services, violation of these Terms, or violation of any third-party rights.
13. Regulatory Compliance
SCB - Samoa Commercial Bank is regulated by the Central Bank of Samoa and operates under Samoan banking law. We may be required to comply with various international regulations, including but not limited to anti-money laundering, sanctions, and tax reporting requirements.
14. Dispute Resolution
14.1 Internal Complaints
We encourage customers to first contact our customer service team to resolve any disputes. We maintain internal procedures for handling complaints fairly and promptly.
14.2 External Resolution
If internal resolution is unsuccessful, disputes may be referred to the relevant financial ombudsman service or resolved through the Samoan court system.
15. Governing Law and Jurisdiction
These Terms are governed by Samoan law. Any legal proceedings relating to these Terms shall be subject to the exclusive jurisdiction of the Samoan courts, unless otherwise required by mandatory consumer protection laws.
16. Modifications to Terms
We may modify these Terms at any time with appropriate notice as required by law. Continued use of our services after such modifications constitutes acceptance of the revised Terms. Material changes will be communicated at least 30 days in advance.
17. Severability
If any provision of these Terms is deemed invalid or unenforceable, the remaining provisions shall continue in full force and effect. Invalid provisions shall be replaced with valid provisions that most closely achieve the intended economic effect.
18. Entire Agreement
These Terms, together with our Privacy Policy and any additional terms specific to particular services, constitute the entire agreement between you and SCB - Samoa Commercial Bank regarding the use of our services.
